We appreciate the fact that you like to buy the cool stuff we build and we also
want to make sure you have a rewarding experience while you’re exploring,
evaluating, and purchasing our products, whether you’re at YePP’s online
store, discussing things at a coaches conference, or even on the phone with YePP’s
support team [to make it easier to read, we will refer to these entities as the
YePPstore in this policy].
As with any shopping experience, there are terms and conditions that apply to transactions
at the YePPstore. By placing an order or making a purchase online at the YePPstore,
you agree to the terms in the order document and those set forth in this section, as well as those set out in the other sections linked on this page, collectively YePP’s terms & policies.
returns
We believe you will be thrilled with the products you purchase from the YePPstore.
That’s because we go out of our way to ensure that they’re designed
and built to be just what you need. We understand, however, that sometimes a product
may not be what you expected it to be. In that event, we invite you to review the
following terms related to returning a product.
Importantly, the rights described in this policy are in addition to the statutory
rights to which you may be entitled under the Australian Consumer Law and other
applicable Australian consumer protection laws and regulations.
Please note there may be limitations on your right to return and obtain a refund
for products, however these limits will always be subject to your statutory rights.
For sibisystem returns, you may return your undamaged sibisystem,
with its included accessories, within 14 days of purchase for a full refund. Here’s
the important part: returning your sibisystem may not automatically cancel
or reset any associated third-party service agreements which you have entered into;
eg: you are responsible for your wireless service agreement and for any applicable
fees associated with your third-party wireless account. Please contact your provider
for more information.
For any other undamaged product, simply return it with the original receipt and
in its original packaging within 14 days of the date you receive the product. If
the item is returned within this timeframe, we’ll exchange it, or offer a
refund based upon the original payment method. For returns relating to a purchase
from a YePPstore with a physical presence [like at a coaches conference],
YePP will process a refund credit to the credit card you used to make the original
purchase within 10 business days.
Please note the following:
- YePP will not refund cash, even if it was tendered in the original transaction
- products can be returned only in the country in which they were originally purchased
- except where required under the Australian Consumer Law or other applicable consumer
protection laws or regulations, the following products are not eligible for return:
any product which has been customised or individualised, eg – laser engraved with an individual's or organisation’s
name,
electronic software downloads, subscriptions to the software-update programme, a
YePPgiftcard, and any YePPdeveloperconnection products
- in the case of items returned with a gift receipt, YePP will offer you an YePPgiftcard
equal to the purchase price of the gift, including tax and any other fees
- except where required under the Australian Consumer Law or other applicable consumer
protection laws or regulations, opened, packaged, third-party software cannot be
returned if it contained a seal with the software license on the outside of the
package and you could read the software license before opening its packaging. As
an exception, you may return YePP branded software if you do not agree to the licencing
terms; however, you may not retain or otherwise use any copies of returned software
YePP sibisystem purchase
The purchase and use of YePP’s sibisystem is subject to the YePP terms &
policies found at www.yepp.com.au
In addition, by purchasing a sibisystem, you expressly acknowledge that:
- any product which has been customised or individualised is not eligible
for return
- a third-party wireless service plan is required to activate all sibisystem
features
- making unauthorised modifications to the software on any device in the sibisystem
violates the sibisystem software license agreement
- should you be unable to use your sibisystem due to an unauthorised software
modification, its repair will not be covered under the warranty, however this will
not affect any rights to which you may otherwise be entitled under the Australian
Consumer Law and other applicable Australian consumer protection laws and regulations
- YePP may, in its sole discretion, refuse or cancel any order and limit order quantity
- YePP may require additional qualifying information prior to accepting or processing
any order
wireless services
Some YePP products utilise third-party wireless services that may incur extra costs
and are governed by the terms of a separate agreement between you and your selected
wireless service provider.
pricing and price reductions/corrections
With regards to pricing, YePP reserves the right to change prices for products displayed
at/on the YePPstore at any time, and to correct pricing errors that may
inadvertently occur.
Should YePP reduce its price on any YePP branded product within 14 calendar days
from the date you receive your product, feel free to contact the YePP support team
to request a refund or credit of the difference between the price you were charged
and the current selling price. To receive the refund or credit you must contact
YePP within 14 calendar days of the price change. Please note that this excludes
limited-time price reductions, such as those that occur during special sales events.
order acceptance and confirmation for online purchases
Once we receive your order, we’ll provide you with an email order confirmation.
Your receipt of an order confirmation, however, does not signify YePP’s acceptance
of your order, nor does it constitute confirmation of our offer to sell; we are
simply confirming that we received your order. YePP and the YePPstore reserve
the right at any time after receiving your order to accept or decline your order
for any reason. If YePP cancels an order after you have already been billed, YePP
will refund the billed amount.
personal identification
By placing an order or making a purchase online at the YePPstore and by accepting the YePP
terms & policies,
you agree to and are satisfied that YePP have identified you as the signatory to the order or contract
by means of YePP’s earlier authentication of one or more of the following - your registered email
credentials, mobile phone number,
or YePP sign-in credentials. By accepting the YePP terms & policies, you are also indicating your intention to sign the relevant order or contract.
consent to the method of signing
Prior to placing an order in the YePPstore you are required to sign-in by entering a valid username
and password combination which is authenticated by YePP. You consent to this ‘sign-in’ being used as
the method of signing at the YePPstore.
authority to act
When placing an order or entering a contract with YePP, if you are doing so on behalf of an organisation you warrant to YePP that you have the authority to act for and on behalf of that organisation with their knowledge and consent, and as their duly authorised agent.
shipping & delivery
Please review the shipping & delivery page to learn about how and when
you will receive the products you purchased from the YePPstore. Since the
actual delivery of your order can be impacted by many events beyond YePP’s
control once it leaves our facilities, YePP cannot be held liable for late deliveries.
We will, however, work with you to ensure a smooth delivery.
end-user customers only
The YePPstore sells and ships products to end-user customers only. You
may not purchase products at the YePPstore for resale, and, to the extent
permitted by applicable law, we reserve the right to refuse or cancel your order
if we suspect you are doing so.
australian sales only
The YePPstore currently accepts orders from billing and shipping addresses
within Australia only. YePP does not ship products purchased at the YePPstore
to an address outside of Australia at present. You may register at YePP’s
website to be informed when we’ll be distributing to your region. YePP products
are subject to applicable export control laws and regulations, and must be purchased,
sold, exported, re-exported, transferred, and used in compliance with such export
laws and regulations.
product availability and limitations
Given the popularity and/or supply constraints of some of our products, YePP may
have to limit the number of products available for purchase. YePP reserves the right
to change quantities available for purchase at any time, even after you place an
order. Furthermore, there may be occasions when YePP confirms your order but subsequently
learns that it cannot supply the ordered product. In the event we cannot supply
a product you ordered, YePP will cancel the order and refund your purchase price
in full.
payment options
The payment & security page describes the various methods you can use to
pay for products at the YePPstore.
data protection
By placing your order, you agree that we may store, process and use data
collected from your order form as set out in our privacy policy. You also
agree that we may transfer such data to other companies in the YePP group of companies.
You may obtain a copy of the data held by us concerning you on request in writing.
We reserve the right to charge an administration fee for processing such request.
If any data held by us concerning you is incorrect, we will correct it on your written
request.
